HKU Law Call for Papers: The Empirical Turn in Chinese Legal Research: Challenges, Strategies, and Solutions (due: 30 Nov 2022)

The Empirical Turn in Chinese Legal Research:
Challenges, Strategies, and Solutions

CALL FOR PAPERS

Empirical studies of the Chinese legal system have proliferated in recent decades. This trend has only been accelerated by greater generation of data on the one hand and methodological innovations in the social sciences on the other. Empirical legal research promises to enrich our understanding of legal phenomenon and to furnish a knowledge base for debating legal doctrine and theory. But the apparent objectivity of numbers can also mislead those unfamiliar with the assumptions and extrapolations underlying many of the conclusions drawn from quantitative research. To foster critical and constructive discussion about this emerging field, the University of Hong Kong Faculty of Law will host a conference on " The Empirical Turn in Chinese Legal Research: Challenges, Strategies, and Solutions" to be held in-person at the University’s Centennial Campus on 9 and 10 January 2023. The conference organizer will cover the lodging and travel expenses of all invited speakers.

Submissions may address one or more of the following topics:
  • Data generation and collection
  • Methodological choices and trade-offs
  • The generalizability or representativeness of small or local samples
  • The relationship between empirical and theoretical or doctrinal research
Submission requirements:
The submission must address the topic of the call for papers, including but not limited to the topics listed above.  Proposals may be submitted as drafts or abstracts of approximately 500 words.

Submissions should be made through the following form on or before 30 November 2022: https://hku.au1.qualtrics.com/jfe/form/SV_5mr7O0rwf7l6JLw

Acceptances will be communicated by 7 December 2022. In addition, a special issue of the Hong Kong Law Journal will be dedicated to the proceedings of the conference. Submissions may be revised before publication. Final manuscripts are due 30 April 2023. All enquiries should be addressed to Ms. Yin Xiaohan at yxh0222@connect.hku.hk.

CALL FOR PAPERS - Berkeley Center on Comparative Equality and Anti-discrimination Law (BCCE) 9th Annual Conference 2022

BEKELEY CENTER ON COMPARATIVE EQUALITY
& ANTI-DISCRIMINATION LAW
9th ANNUAL CONFERENCE 2022

Hosted by the University of Hong Kong, Faculty of Law, the Centre for Comparative
and Public Law, the Human Rights Hub, and the Equality Rights Project

22-24 June 2022

Comparative Equality Law in a Post-Pandemic World

The ninth annual conference of the Berkeley Center on Comparative Equality & Anti-Discrimination Law (BCCE) will be held at the Faculty of Law at The University of Hong Kong from 22-24 June 2022. Previous conferences were hosted in Paris (Sciences-Po 2012), California (Berkeley Law 2013), Brussels (Université Libre de Bruxelles 2014), Shanghai (Jiao Tong University 2016), Dublin (Trinity College 2017), Melbourne (Melbourne Law School 2018), Stockholm (University of Stockholm 2019), and Cape Town (University of Cape Town 2021).

We plan to hold the conference on site in Hong Kong with options for online participation for those unable to join us in person. However, if a face-to-face event turns out to be impossible because of ongoing travel restrictions or other unforeseen circumstances, we will organize an entirely virtual conference instead.

The conference will expand on many of the themes explored at the BCCE’s previous events and within its various working groups. It will focus on what Covid-19 has revealed about the causes and nature of inequalities which exist within and across countries and regions. Calls to tackle deep-seated structural and intersectional discrimination have increased in recent years, but so has the strong backlash against these campaigns. Indeed, in some places we see attempts to dismantle hard-won, progressive legal and policy change. In others, ongoing efforts to achieve much needed reform have been stalled or defeated.

With these realities in mind, the conference will consider possibilities for crafting effective short-term and long-term responses as we move forward in a vastly unequal post-pandemic world. These may include: reforms to - or the better implementation of – equality and antidiscrimination law; improved enforcement mechanisms; re-energised social movements; fully representative governance; ensuring equality in economic recovery efforts; tackling inequalities in health care, education, employment, and other sectors; and identifying new, creative solutions in the digital space, the arts, and the media.

These challenges and more will shape the discussions and plenary sessions at the 2022 conference. As always, the comparative insights and ideas presented by scholars from around the world will enrich the conference experience. We hope to further expand the BCCE’s network and particularly encourage emerging scholars - from within the Asian region and elsewhere - to join us.

Paper proposals may address the broader themes described above or any area of equality and anti-discrimination law. Specific conference sub-themes reflect the focus of BCCE’s working groups:
• Covid-19
• Digital Equality
• Disability Rights
• Immigrant Justice and Climate Refugees
• Pay Equity and Living Wage
• Sexual Harassment and Violence
• Global Systemic Racism
• LGBTQI

Cross-cutting themes include: structural discrimination; equality and governance; equality and economic recovery; equality and socio-economic rights (healthcare, education, employment, etc.); enforcement and institutional responses; the impact on communities such as older persons, children, indigenous peoples, and non-citizens; the role of the arts and media in promoting equality; and civil society participation and social movements.

We are now inviting submissions for workshop presentations on topics related to these themes, and aspects of equality law more generally. Please submit a completed abstract of up to 500 words to bccehk@hku.hk on or before 1 December 2021. Please include a brief biography (suitable for publication on the conference website) and clearly indicate your objectives and methodology in your abstract. The abstracts will be reviewed by the conference committee and invitations to present will be sent out by early February 2022. Full papers will be due on 15 May 2022. Note that initial abstracts must be submitted in English, but we may be able to make some accommodation if you wish to present in another language at the conference. Please indicate this in your submission.

Call for Papers: Special Issue on Street Protests and Human Rights (APJHRL) [DEADLINE: end of Jan 2020]

Asia-Pacific Journal on Human Rights and the Law
Centre for Comparative and Public Law

Call for Papers

Special Issue on Street Protests and Human Rights

In 2019 Hong Kong saw unprecedented confrontations between police and protesters sparked by human rights concerns with a proposed amendment bill that would have enabled the surrender of fugitive offenders to other parts of China.  Street protests leading to clashes with the police also flared up in Moscow, Kashmir, West Papua, Cape Town, Mexico, Zimbabwe, and Honduras. Police powers and public order measures can have severe consequences for protesters, journalists, and other members of the public.  These recent events have given rise to many important human rights law issues that may require the attention of courts, tribunals, legislative bodies, governments, and international organisations. To contribute to a global discussion of these issues, the Asia-Pacific Journal on Human Rights and the Law is soliciting new scholarship on the human rights law issues of street protests in the Asia-Pacific or of potential interest to the region, particularly in terms of international standards.  An editorial committee of experts will peer review submitted papers and the best ones will be published in a special issue of the journal planned for issue 1 of volume 21 (2020).
Established in 2000 and now based at The University of Hong Kong, the Asia-Pacific Journal on Human Rights and the Law is the leading law journal on human rights in Asia.  It has published influential articles on important human rights issues occurring in most Asia-Pacific jurisdictions.  Two issues of the journal are published each year. Abstracts of articles are indexed on Scopus and searchable on Westlaw.  Full text is available on BrillOnline, EBSCO, and HeinOnline. The journal’s website is https://brill.com/view/journals/aphu/aphu-overview.xml.
Submission instructions. For the special issue, papers should be no longer than 12,000 words (inclusive of footnotes).  Please follow the OSCOLA (4th edn) standard for the citation of legal authorities. Email papers to apjhrl@hku.hk.  For papers to be considered for the special issue, they must be received by 31 January 2020.

Call for Papers: Limitations on Trademark Rights from Comparative and Interdisciplinary Perspectives (HKU Law & Technology Centre)

Limitations on Trademark Rights from Comparative and Interdisciplinary Perspectives

Deadline for Abstract Submission: September 14, 2018

The Law and Technology Centre at the University of Hong Kong Faculty of Law and the Engelberg Center on Innovation Law & Policy at New York University School of Law will next year co-sponsor a conference on limitations on trademark rights. The conference will bring together scholars from around the world to explore the nature and scope of those limitations from comparative and interdisciplinary perspectives. The conference will be held at the University of Hong Kong on January 7-8, 2019.
The Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) sets no minimum standards for limitations on trademark rights, such as fair use and exhaustion. At the domestic level, the courts in various jurisdictions have adopted conflicting opinions on how to decide cases involving such limitations (e.g., nominative fair use). Comparative studies are therefore useful in understanding the differing legal standards for the limitations on trademark rights adopted in different jurisdictions. Moreover, conventional wisdom largely justifies trademark rights limitations from free speech or market competition perspectives, with other theoretical approaches such as social and cultural studies enjoying limited application in considering the nature and scope of those limitations. Against this backdrop, the conference organizers welcome submissions of papers developing new thoughts and theories on limitations on trademark rights by examining them through a comparative or interdisciplinary lens.
The Rt. Hon. Professor Sir Robin Jacob will deliver the conference’s keynote speech, and a number of leading trademark scholars have already agreed to present papers. A limited number of presentation slots have also been reserved for scholars to be selected through this call for papers. Both senior and junior scholars are encouraged to submit abstracts of the papers they intend to present. Abstracts will be selected based on scholarly merit and originality.
Please submit an abstract (no more than 300 words) to Ms. Grace Chan at mcgrace@hku.hk by September 14, 2018. The submission should also include your name, position, institutional affiliation and e-mail address.
All applicants will be informed of the selection outcome by October 2, 2018. Financial support is available for scholars who experience difficulty obtaining a sufficient travel grant from their institution.
All conference enquiries should be addressed to Ms. Grace Chan at the above e-mail address or at (+852) 3917-4727.

Call for Papers: 11th East Asian Conference on Philosophy of Law @ HKU (13-14 Dec 2018)

11th East Asian Conference on Philosophy of Law
“Justice, Dignity and the Rule of Law”

*Call for Panels and Papers*

Faculty of Law, The University of Hong Kong
13-14 December 2018

We are pleased to announce that the 11th East Asian Conference on Philosophy of Law will be held in Hong Kong on December 13-14, 2018, under the auspices of the University of Hong Kong’s Faculty of Law and its Centre for Chinese Law. The event is also part of the celebration of the 50th anniversary of the Faculty of Law of the University of Hong Kong. The overarching theme of the conference is “Justice, Dignity and the Rule of Law”.
The East Asian Conference on Philosophy of Law has been held once every two years since 1996. The China University of Political Science and Law in Beijing hosted the 10th conference in 2016, and Hankuk University of Foreign Studies in Seoul hosted the 9th conference in 2014. The conferences provide a forum for dialogue among East Asian scholars of legal philosophy and other scholars interested in Asian legal philosophy.
The 11th Conference will be divided into plenary sessions and parallel sessions. We now invite proposals to present papers at the Conference.  A proposal to present a paper at the Conference should include the title and abstract of the paper. If you are interested in submitting a proposal for the conference, please note the following:
1.  The closing date for submission of proposals is 30 June 2018.
2. The conference will be mainly in English and Chinese. Proposals to present papers at the Conference and panel proposals (mentioned below) should be written in English or Chinese. Oral presentations at the Conference should be in English or Chinese, except that (1) in panels formed (according to the procedure mentioned below) by Japanese or Korean scholars, the oral presentations may be in English, Japanese or Korean (scholars speaking in Japanese or Korean are strongly encouraged to provide a written English translation of their presentations); (2) interpretation will be provided for specially invited speakers at the plenary sessions who speak in Japanese or Korean (who will provide a written English translation of their speeches).
3.  The proposed papers may relate to any aspect of philosophy of law or related fields, and need not be limited to the general theme of the conference (“Justice, Dignity and the Rule of Law”).
4.  Every participant at the Conference (including paper presenters, and chairmen and discussants at the panels mentioned below who are not presenting papers themselves) should submit the ‘individual proposal form’. Paper presenters will make an oral presentation at the conference (approximately 15 minutes). Submission of full papers is welcomed but not required.
5.  Proposals to form a panel at a parallel session are welcomed. Panel organisers should submit a ‘panel proposal form’. Panel members presenting papers at the panel should also submit ‘individual proposal forms’. The ‘panel proposal form’ should include the panel topic, the name of the chair and/or discussant, the names of the presenters of papers, and the title of each paper. The chair and discussant may also serve as a paper presenter. The same person may serve as both chair and discussant.
6.  The conference registration fee is waived; however, participants who would like to join the conference dinner will be required to make a payment in advance. Conference participants are responsible for their own travel and accommodation expenses. A list of recommended hotels will be provided on the conference website.
7.  Inquiries may be emailed to: shelbyc@hku.hk.
The Conference will be an excellent opportunity for you to meet East Asian scholars of the philosophy of law to discuss topics of common interest. We hope you will be able to join us in Hong Kong!  To access the Conference website, click here.

Confirmed keynote speakers:
Professor Peter Yu
Co-Director Centre for Law and Intellectual Property Texas A&M University School of Law
Dr Rebecca Giblin
Deputy Director, Monash JD and Monash Centre for Commercial Law and Regulatory Studies (leading Innovation and Intellectual Property) Monash University Faculty of Law

Co-convenors:
Associate Professor Susan Corbett
General Secretary APCA

Associate Professor Haochen Sun
Director, LLM in Information Technology and Intellectual Property Law University of Hong Kong Faculty of Law

Call for Papers: Abstracts of approximately 350 words should be sent to Susan Corbett via email at susan.corbett@vuw.ac.nz by 10 October 2016. Each abstract submission should include the author’s name, title and affiliation. Abstracts will be approved on a rolling basis.  The Conference theme is: Copyright in the Asian Pacific: the challenges and opportunities.  At APCA’s inaugural conference in November 2015, Professor Adrian Sterling presented a draft Asian Pacific Copyright Code for discussion. As is usual for international legal instruments, the Code is drawn in broad terms, leaving much discretion to individual States. The theme of this Conference will address additional possibilities for the Code - should it for example include specific minimum standards and /or exceptions for the protection of indigenous culture; orphan works; Internet and other digital works; cultural heritage; education and libraries, etc. If so, what form should these minimum standards and/or exceptions take? Conversely, are there matters that should be omitted from the Code and left entirely to the legislatures of individual States?
Further details about the conference, including registration and accommodation options, will be available shortly on the APCA website.

Spectacular Law - CALL FOR PAPERS (HKU, 8-10 December 2016)

Law, Literature and the Humanities Association of Australasia Conference 2016

The Faculty of Law, The University of Hong Kong, 8-10 December 2016
Preceded by a half-day Graduate Research Student Workshop

CALL FOR PAPERS

The LLH Association of Australasia invites researchers working at the intersection of law and the humanities to Hong Kong in 2016 to explore the complex relations between law, theory, culture and visuality. This conference invites participants to re-affirm the enduring capacity of interdisciplinary, creative and critical legal scholarship to allow us to see the law otherwise.
The theme of ‘spectacular law’ invites reflection on the performance and dramaturgy of political and legal power, the affective lures of sovereignty and the technologies that reveal – and conceal – legality, dissent, (dis)obedience, and different modalities of regulation. This conference will examine the various ways in which we can see, and be seen by, law, politics and power. The location of this year’s conference prompts its theme. Hong Kong is a visually striking city: fading tower blocks, gleaming edifices, remnants of a colonial past, and canopies of neon suspended over street corners, all enframed by lushly forested hills and the increasingly contested waters of the South China Sea. The powerful visual affect, as much a result of the city’s geography as it is of its legal and political orderings, inspires an exploration of the spectacle.
We invite either individual paper proposals or pre-arranged panels of 3-4 papers. Participants may present in the form of a traditional academic paper, panel discussion, or innovative presentational forms that engage video, performance or other media. We will consider proposals in any area of law, literature and the humanities. However in addressing the conference theme papers might wish to reflect on the following questions:

  • What are the techniques through which law’s operative power is made (in)visible today?
  • How do the various methodologies of ‘law and humanities’ allow us to approach questions of speech, surveillance, censorship, and freedom?
  • How are the spatial, aural, textual and haptic dimensions of law and power refracted through – or obscured by – a focus on the law’s visuality, its spectacles and spectaculars?
  • In what ways might we think about the performance of law in a plurality of settings: on the stage, the screen, in literature or in the courtroom?
  • Does the development of new technologies necessitate the re-examination of how justice is seen to be done?
PLENARY SPEAKERS

Laurent de Sutter, Professor of Legal Theory at Vrije Universiteit Brussels
Christine Black, Senior Research Fellow at the Northern Institute, Charles Darwin University

DEADLINE FOR ABSTRACTS AND PANEL PROPOSALS 15 MAY 2016
